Divorce

Although many people think that with so many marriages ending in divorce the mechanics for obtaining a divorce should be very straightforward, the process can be complicated, especially when there are financial or children issues to resolve.

The cost of instructing JMW Solicitors to prepare the divorce documents is not as much as you might think. Unless the proceedings are defended, your divorce costs are likely to be in the region of £500 plus VAT and Court fees. These costs are less than those quoted by many online divorce websites.

The amount of the costs will depend upon how much advice you require prior to the commencement of the divorce proceedings, and how co-operative or otherwise your husband or wife is.

If both parties are agreed that the marriage has broken down, and there are grounds for divorce, then a divorce can be finalised within six months of instructions, subject to financial and children issues being resolved.

Cohabitation

Many couples decide to live together rather than marry. There is a common belief that if you live with someone for a certain length of time you become "common law man and wife". This is not correct.

There is no one single piece of legislation that a separating partner can use in order to resolve financial and children issues on the breakdown of the relationship. It is for this reason that if you are thinking about separating from your partner you should get early advice about the financial consequences of doing so.

If, after taking advice, you do decide that you want to separate, it is important that any financial or children arrangements agreed on separation are formally recorded so as to avoid repeated Court applications or claims being made against property.

Pre-Marriage and Pre-Cohabitation advice

Many couples, when they decide to live together or marry do not think of the potential financial consequences.
