The Health and Safety Executive and its powers

The HSE has far reaching powers. It can investigate alleged wrongdoing and poor practices in a workplace, and has the right to enforce its powers, carrying out investigations which can result in charges.

Enforcement is designed to ensure that serious risks are dealt with quickly, that businesses comply with the law and that if companies fail to adhere to the law they are held to account.

The HSE can warn duty holders – the person at a company appointed with health and safety responsibilities – that they are failing to uphold standards in writing, as well as face to face. They can also warn that laws are being potentially breached.

  • Serve improvement and prohibition notices
  • Withdraw a company’s approvals
  • Make changes to their licences or exemptions

  • Prosecute a company
