We can help you make an informed decision as to whether an injunction is appropriate in your case. We provide reliable legal advice on injunctions, which fall into the following categories:
- Financial – If you suspect your spouse/civil partner is dissipating assets or removing them from this country, it may be possible to obtain an injunction to prevent such behaviour. This would safeguard the remaining assets until such time as conclusion of a financial settlement. In these circumstances, you would be asking the court to make a 'freezing order.'
- Domestic violence –If you are subject to domestic violence, which includes behaviour that may not be physical abuse but psychological abuse, sexual abuse or emotional abuse, then it may be possible for you to apply for an injunction to prevent this type of behaviour. In these circumstances, you would be asking the court to make a 'non-molestation order'. This type of order would ensure your well being and that of your children.
- Occupation of the home – If you are suffering from significant harm or likely to, then you may wish for your cohabitee/spouse/civil partner to leave your home. Alternatively, if you have left your home and wish to return, you may wish to suspend your cohabitee's/spouse's/civil partner's right to occupy your home.
Applying for an 'occupation order' can not only prevent your cohabitee's/spouse's/civil partner's occupation of your home but can also prevent them from entering the surrounding area.
