What is Parental Responsibility and do I have it?
Parental Responsibility refers to all the rights, duties, responsibilities and authority that a parent of a child has by law. It includes being involved in important decisions such as which school your child should attend and what medical treatment they should receive.
You automatically have parental responsibility for your child in the following situations:
- You are the mother of the child.
- You are married to the mother of your child at the time of the child’s birth.
- You jointly adopted the child.
- After 1 December 2003, you jointly registered the birth of the child with the mother.
If you do not have parental responsibility then, in practical terms, this may mean that official institutions like schools, doctors and social services will not co-operate with you. It may also mean that you are not involved in the important decisions.
How do I get Parental Responsibility?
Parental responsibility can be acquired through one of the following routes:
- Parental responsibility agreement with the mother.
- Parental responsibility or residence order made by the court.
