Libel Payout After Welsh Daily Post Accepts Kebab Shop Drug Raid Story Error

03/12/2014

Owners and staff at a North Wales kebab shop have accepted a five-figure damages payout after a newspaper admitted a story about a drugs raid on the premises was “incorrect”.

The three men sued the Welsh Daily Post after it published a report and photographs alleging that Caru Kebabs on Poole Street, Caernarfon, had been the target of a search by police in August this year.

As a result of the article, shop owners Aamer Al Kojari and Mohammed Hussein were inundated with calls and visits from concerned customers.

Nick McAleenan, a media lawyer at JMW Solicitors, complained that the men were unable to receive orders because their telephone lines were constantly engaged following the publication. He said that the two men and an employee, Emad Ahmad Mohammed Nabi, had been forced to consider closing the store to avoid the “deluge of enquiries”.

The Welsh Daily Post later conceded that “mistakes” had been made and acknowledged in print that the investigation had actually involved an entirely different address on the same street which was not linked to Caru Kebabs. Nevertheless, said Mr McAleenan, the store suffered reduced sales because of the controversy.

Mr Al Kojari, Mr Hussein and Mr Nabi have now accepted a subsantial five-figure sum in damages from Trinity Mirror, the owners of the Welsh Daily Post, and payment of their legal costs.

Mr McAleenan said the men were delighted to have brought the episode to a close.

“They are all greatly relieved to have suspicions created by an erroneous article lifted from the store and their own reputations.

“Even alleging that someone is being investigated by police can have very serious consequences.

“My clients are relieved that the error has been admitted and look forward to putting this unfortunate incident behind them.

“They have asked me to thank their customers, friends and family for their support during what has been a very stressful period.”
