About Prison Service Injury Claims

HM Prison Service has a duty to provide inmates with a reasonable standard of living and to provide prison officers with a safe working environment. It also has a responsibility to protect vulnerable prisoners from possible assaults if a threat is posed by fellow inmates.

Should these duties not be met, the risk of injury can be heightened. If this happens and you are hurt as a consequence, you may be in a position to make a claim for compensation.

Suffering an injury can be upsetting and traumatic. It can also put you at a disadvantage on the labour market, either temporarily or permanently. Claiming compensation allows you to seek redress from those responsible for causing your injury, and the money you receive can go towards supporting you if you are unable to work. It can also help to pay for medical care needed as a result of your injury, and other out of pocket expenses you may have suffered.

Claiming for an Injury as an Inmate

As an inmate, if you are injured while incarcerated and it was not your fault, you may be entitled to make a personal injury claim. Injuries may be sustained in any number of ways, including:

  • A trip or fall inside the prison
  • An incident in your cell
  • An incident while working in the prison
  • Assault by another prisoner

Your personal safety should be adequately protected at all times. If you have suffered an injury as a result of any of these scenarios, or have been hurt in any other way that was not your fault, we are able to help. Our team has years of experience and can help you get the appropriate compensation.

Claiming for an Injury as a Prison Officer

Prison officers work hard every day to protect the safety of inmates and fellow officers. Unfortunately, accidents can sometimes happen. You are entitled to claim for an injury arising from any number of scenarios. The most common claims that we have handled include:

  • Slips and trips occurring as the result of misplaced substances
  • Muscular and/or back injuries - including spinal injuries - as a result of manual handling errors
  • Injuries caused by violent inmates
