About Winter Weather Accidents

The majority of accidents that occur as a result of winter weather are unavoidable. However, there are times when an incident takes place that could have been avoided, were it not for the negligence or mistake of a third party.

Examples include:

  • Slipping on ice while working, after your employer failed to ensure the area was gritted
  • Slipping outside retail outlets or other public areas, after the third party responsible failed to ensure the area was safe for customer access
  • Being involved in a road traffic accident because the road was icy but not gritted
  • Being hit by another vehicle due to negligent driving in the dark during what would be daylight hours in the summer

Regardless of the circumstances of your accident, if the accident was caused by somebody else’s negligence, you are entitled to make a claim for compensation.

Who is Responsible?

Determining responsibility for your accident depends on where it occurred. For accidents that take place in work, your employer can be held accountable for not taking appropriate measures to ensure your safety. If you have been injured in a shop, restaurant or another public place, then the owner of the establishment will be liable for your injuries.

Local councils are responsible for maintaining the roads and pavements in their authority, and may be held liable if it is proven that they failed to take the appropriate measures to prevent an accident from happening on their highways.

Our solicitors have years of experience handling winter weather accident claims and will therefore be able to determine the party responsible for your injuries to pursue for compensation on your behalf.
