About Hair Damage Claims

Hairdressers and beauty technicians go through comprehensive training before working on a person’s hairstyle or cut; however, sometimes things can go wrong during hair appointments that leave you with physical injuries and suffering from psychological distress.

Many hair treatments involve the use of potentially harmful substances and strong chemicals, which can cause injury if used incorrectly for example the treatment being left on your hair too long.  In some instances, injuries could have been prevented with the simple use of a patch test; a procedure that may be overlooked even though bleaches and hair dyes often cause allergic reactions.

Can you claim for colour damage or over-bleaching? 

It is possible to be compensated for when a hairdresser has over-bleached or caused colour damage to your hair as part of a personal injury claim, however you cannot make a claim if this is the only issue you’ve experienced at a hair or beauty salon.  You must also have suffered some physical harm or distress, such as burning of the skin or an allergic reaction, in order for your claim to be valid.  If in doubt, our legal advisors will be able to tell you whether or not you will be able to claim compensation.  

What is the Hair Salon’s Responsibility?

The hairdressing industry is not regulated, which means that there may be individuals who are operating as hairdressers, who have no qualifications. Whilst the Hairdressing Council is pushing for a statutory change that will mean all practicing hairdressers will need to be registered, this sadly isn’t the case at present, with current estimates suggesting that only around 10% of hairdressers are registered with them. 

Although the Council has the power to deal with complaints against registered hairdressers, it doesn’t have the same ability to deal with unregistered ones and encourages individuals who have suffered neglect at the hand of unregistered hairdressers to seek legal advice.  Despite there being no clear regulation for hair salons, owners and stylists are still accountable for personal injuries caused on their premises, and a claim can be made against them for damage done to your hair.

Home hair dye kits

If you have suffered an injury after using a home hair dye kit, such as an allergic reaction to some of the chemicals used in the dye, it is possible you will be able to make a claim for compensation.  In order for your claim to be valid however, it will need to be proven that you have taken all possible steps (such as undergoing the relevant patch tests) to ensure that to the best of your knowledge, the kit was not going to cause you harm.
