Fatal Accidents: Who Can Claim?

Under the terms of the Fatal Accidents Act 1976, ‘dependents’ of the deceased can make a fatal accident compensation claim. A ‘dependent’ refers to someone who depends upon the victim for everything from financial and emotional support to help around the house.

The interpretation of the term is therefore very broad; anyone from a child or former husband or wife of the deceased to an aunt or uncle can be classified as a dependent. However the court also places some restrictions on the term, for example a co-habitee of the accident victim must have lived with them for a minimum of two years to be classed as a dependent.

How do I Make a Claim?

First you need to decide if the accident in question was the fault of another person; this person might be another driver, a manager at work or a doctor or nurse. In some cases this will be clear, and others it will be less obvious. If you are at all unsure, a solicitor will be able to help.
