Unfair Dismissal

The law relating to unfair dismissal changed substantially in October 2004 with statutory grievance and disciplinary procedures introduced. JMW Solicitors are in a position to advise on any consequential changes needed to your own grievance and disciplinary procedures as a result of the forthcoming legislation.

If you are an employee you must be sure to file your claim within three months of the date of termination of your contract of employment. You therefore need to consult JMW Solicitors at the earliest opportunity.

If you are an employer you may wish to consult JMW Solicitors prior to taking the decision to dismiss to ensure that the dismissal is likely to fall within one of the fair reasons for dismissal set out in The Employment Rights Act 1996.
