The implementation of the Legal Aid, Sentencing and Punishment of Offenders Act 2012 removed the recoverability of success fees and ATE premiums from opponents (except in limited circumstances). Solicitors, in particular, those conducting lower value personal injury litigation, have continued to charge their clients success fees and ATE premiums with those additional liabilities being deducted from damages.

Certain solicitor and costs firms are encouraging individuals to challenge the success fee and ATE premium deductions charged by their former solicitors and Solicitors Act 1974 detailed assessment proceedings are on the rise.
