Successful action results in the removal of a registered legal charge – obtained fraudulently – from the title to our client’s property

Our specialist solicitors in the Property Litigation team provided assistance in connection with the removal of a registered legal charge that had been fraudulently obtained against the registered title of a property owned by our client.

The beneficiary of the charge, a private limited company, had been dissolved many years earlier which complicated matters.
We were successful in having the beneficiary company restored to the Register at Companies House and subsequently obtained a declaration and Order from the court that:-

  1. The Charge had been obtained by way of fraudulent means; and
  2. H.M. Land Registry rectify the title to the property by removing the charge.
