Philip joined JMW in London in January 2020, having previously been a director and head of IP disputes at a leading intellectual property boutique.

Philip, having graduated from Durham and Oxford universities in Law and Intellectual Property respectively, is well known for identifying technicalities in any given IP litigation case and using them to the benefit of his clients, while being straight talking.

Philip’s areas of expertise include identifying his clients' intellectual property, assisting with securing that intellectual property through registration and protecting it by way of specialist intellectual property dispute resolution.

Philip has been described by the Legal 500 as a "next generation lawyer" and "very sound litigator" and is well known for successfully defending parties in complex IP court proceedings in both the Intellectual Property Enterprise Court and High Court. Philip also deals with intellectual property oppositions and invalidity proceedings in both the UK Intellectual Property Office and the EU IPO.

Outside of work, Philip is a keen sailor and is often to be found sailing along the South Coast.

Philip’s Notable Cases

Philip’s approach to IP litigation has resulted in stunning victories for his clients, who often comment that they “would rather be with him than against him”. Philip is particularly renowned for his successes in the Red Bus case, Argos vs Argos, being the first to recover uncapped costs for theBigWord in the IPEC and successfully defending substantial High Court breach of confidence cases brought by Invista Textiles and FreshAsia Foods.   • Invista Textiles (UK) Limited and another v Viderabio Limited and others [2019] EWHC 58 (Ch) – successfully defending a leading breach of confidence claim in the biotech industry and obtaining his clients’ costs, despite the triggering of a Part 36 offer.
  • Freshasia Foods Ltd v Lu [2018] EWHC 3644 (Ch) & [2019] EWHC 638 (Ch) successfully defending an interim injunction in relation to non-compete clauses and then going onto defend at trial the substantive breach of confidence claim. Philip also obtained indemnity costs for his client.
  • Glencairn Crystal Studio Limited and another v Dartington Crystal (Torrington) Limited – successfully defending High Court interim injunction application, with the proceedings settling pre-trial.
  • Link Up Mitaka Ltd (t/a Thebigword) v Language Empire Ltd & Anor [2018] EWHC 2633 & EWHC 2728 (IPEC) – a leading successfully inquiry as to damages claim and subsequently obtaining an unprecedented uncapped costs award in the IPEC.
  • Argos Ltd v Argos Systems Inc [2017] EWHC 231 (Ch) & [2018] EWCA Civ 2211 – successfully defending Argos Systems in the High Court, Court of Appeal and Supreme Court in a leading trade mark case and appeal in relation to the Google AdSense programme.
  • Temple Island Collections Limited v New English Teas Limited and another [2012] EWPCC1 – successfully bringing copyright infringement case, known as “the Red Bus Case”.
  • Redwood Trees Limited v Warren Aspey t/a Redwood Tree Surgeons [2011] EWPCC 014 – successfully bringing passing off proceedings where the injunction was based upon postcodes.
