Employment Tribunal Win for Ex City Link Employees 


Employment lawyers at full service law firm JMW Solicitors LLP have successfully won an Employment Tribunal claim for ex City Link employees for City Link Limited’s failure to properly consult.

Led by Liz Cotton, the team at JMW have worked hard on behalf of 340 ex-City Link employees who worked at depots across the country to gain compensation after the firm went into administration on Christmas Eve with the closure of 51 depots and the loss of over 2,500 jobs nationwide. A Tribunal ruled that City Link failed to properly consult with its employees on their redundancy so they are entitled to 90 days’ pay (capped at 8 weeks’ pay due to damages, a maximum of £3800, being paid by the Department of Business Innovation and Skill). City Link have also been ordered to pay the Tribunal fees.

The Protective Award Claim was defended vigorously but in the judgment handed down the Judge stated City Link had a statutory obligation to consult with its employees as they knew what financial trouble the firm was in and evidence was adduced that City Link tried to disguise what was happening.

In the judgment Judge Davis from the Leeds Employment Tribunal commented:

“[The] dismissals were foreseen as a possibility and planned for over some weeks and months, yet nothing was done to consult [with] the affected employees.”

The hearing was held from 18 to 20 April 2016 with judgment reserved until the end of May 2016. JMW lodged the claim on behalf of 340 ex-employees from across the UK and there were 709 ex-employees awarded damages in the UK in total. The team at JMW have also recently won a 2nd Industrial Tribunal in Northern Ireland for 5 ex City Link employees who also are entitled to 90 days’ pay. This followed JMW successfully lodging a claim on behalf of 10 ex-employees from the Belfast depot in November 2016.

Commenting on the claim Liz Cotton at JMW said:

“We are delighted to have won the judgment for City Link’s failure to consult properly over the redundancy of their employees. The Claim was strongly defended by the Government and we are pleased that the Judge felt City Link should have done more to consult with their employees when they knew the company was in trouble. The damages will hopefully help the ex-employees be able to move on after losing their jobs on Christmas Eve with no warning at all.”

Ex-City Link employee Daniel Wilson who was part of the group action commented:

I am happy with the outcome as it was the correct decision. It won’t change what happened regarding City Link ruining so many employees and customers Christmas, however, the outcome helps brings closure to this chapter in so many people’s life’s, meaning we can put it behind us and fully move on. I want to personally thank the employment team at JMW for their hard work and efforts in achieving this desired outcome. Any money I receive I will be donating to a local charity in my area.”
