Manchester Law Firm Receiving Enquiries from JJB Employees
The employment team at Manchester based law firm JMW Solicitors LLP has already been contacted by over 15 employees from JJB regarding a possible group employment action against JJB, who entered administration last week. On Monday the administrator announced that Sports Direct had only bought 20 JJB stores, the brand and website meaning 133 stores would close making 2200 staff redundant.
JMW is dealing with these cases on a no win no fee basis. Confusion has been common about whether an individual can make a claim when their Employer has gone into Administration.
The position is that employees can make a claim whether the store has been brought out of administration now or not. There are three main ways in which former JJB employees may become part of the Group Action.
- All dismissed employees are entitled to notice pay (up to 12 weeks depending upon length of service) and up to 6 weeks’ accrued holiday pay which if unpaid can to some extent be recovered from the Department of Trade and Industry.
- All employees who have worked at a store with more than 20 employees will entitled to become part of a collective bargaining group and pursue further compensation of up to 8 weeks’ pay from the Department of Trade and Industry.
- If a store has been taken over and an employee has not been offered back their old position, it may be possible to take action against the new employer.
Whilst these cases are at a very preliminary stage, the early indications are that each employee may well recover several thousands of pounds and possibly more depending upon how the case progresses.
Commenting on the planned Group Action, Carl Moran, a Partner in the employment team commented;

These cases can often be hard fought, but that is what we are here for, it is what we are good at, and we expect a successful outcome.”
