These are uncertain times for the Family Courts. Today, the Lord Chief Justice issued guidance which at the moment falls short of Court closures. Mr Justice Mostyn, the lead financial remedy Judge, followed by issuing practical guidance as to how financial remedy applications are to be handled during the Covid-19 crisis. The crux of this advice is that physical hearings should be avoided where possible, with FDAs to be conducted by telephone or by consent on paper. More tricky, is the prospect of how to deal with FDRs, which are of course crucial hearings in the process. Mr Justice Mostyn has tackled this by strongly advocating the use of Private FDRs to be conducted remotely, thereby removing them from the court system during the coming weeks and months.
