We are still "No win, no fee" Solicitors!

You may be aware of the recent Government changes which have been introduced to deal with the way in which claims for injuries are funded. These changes came into effect on 1st April 2013, but despite this, we can assure you that we can still provide our clients with a "no win, no fee service.

"No win, no fee means that firstly you do not have to pay anything up front for legal fees or expenses. Most importantly, it also means that if you pursue your claim with us and you do not win, then you do not have to pay us anything!

These Government changes only apply if you win your case. The difference now is that if you win your case, the "success fee (the payment which solicitors are entitled to receive for taking on risky cases, or cases which might fail) now has to be paid by the client, and not the defendant's insurer, which is what was happening before 1st April.

This success fee is capped at up to 25% of the compensation award you receive for your personal injury and past financial losses. It is important to be aware that if part of your claim was for future losses (for example, if your injury was such that it affected your ability to work and put you at a disadvantage on the job market), does not make up part of this requirement. What this means is that it isn't the whole of your compensation claim that is affected by this 25% cap, just the part of the claim which is linked to your actual physical injury, and money you have directly lost or paid out as a result of that injury.

In order to balance this out, what the Government has done is increased the amount of compensation awarded for physical injury by 10%, to try and help absorb these expenses for the individual making the claim, so all is not lost!

ATE Insurance

When you make a claim with us, we will also advise you to take out ATE (After The Event) Insurance. Whilst we can assure you that if we don't win your case, the "no win, no fee service we offer will mean you have no legal expenses, there is a danger of you incurring other unforeseen costs on your case that you may have to pay for.

DON'T PANIC though; ATE insurance covers you in this instance. This is something we can arrange for you, so there is no need to worry about the extra hassle of shopping around for yet another insurance policy. Again, you won't have to pay for this if you don't win your case, we will cover this cost. The only time we will ask you to pay for it is if your claim for compensation has been successful, and we can advise you how much this will be at the very start of your claim.
