Employment Tribunal Win for Ex Hewden Employees in Scotland 


The Employment team at full service law firm JMW Solicitors LLP have successfully won an Employment Tribunal claim in Scotland for ex Hewden employees for Hewden’s failure to properly consult before making staff redundant.

Led by Liz Cotton, the team at JMW have worked hard on behalf of the employees who worked at depots across Scotland to gain compensation after the firm went into administration in November 2016.  The Employment Tribunal in Scotland ruled that Hewden failed to properly consult with its employees on their redundancy so they are entitled to 90 days’ pay (capped at 8 weeks’ pay due to damages, a maximum of £3800, being paid by the Department of Business Innovation and Skill).

The hearing was held on 17 July 2017 at the Glasgow Employment Tribunal with judgment handed down shortly afterwards by Judge Davis. JMW lodged the claim on behalf of 16 ex-employees from Scotland. The firm is leading a separate action which is ongoing in respect of a larger number of UK based staff, this is due to be heard later this year.
