Landmark asbestos ruling nets large payouts for JMW's clients


A landmark Supreme Court ruling has meant that several clients from top Manchester-based personal injury firm JMW now stand to receive hundreds of thousands of pounds in compensation from insurance companies. 

On Wednesday this week it was ruled that sufferers of the asbestos-related cancer, mesothelioma, will be awarded compensation by the insurer of the party who caused their exposure to asbestos and not the insurer when it was diagnosed as the insurers argued in the Supreme Court.

A number of JMW clients have been obliged to settle their cases without knowing whether there would ultimately be a paymaster in place to pay the six figure settlements obtained on their behalf by JMW’s industrial disease team. 

Andrew Lilley, Partner and head of JMW’s Industrial Disease team, said: “I am delighted to be the bearer of good news for these families.  These clients’ cases have all been settled, but we have been waiting for over a year to be able to give them the compensation they are properly entitled to, from the appropriate paymasters.

“Mesothelioma is a deadly disease, and the delays caused by the trigger litigation have meant that many claimants sadly passed away during the course of their case, without knowing whether their families would receive compensation.  This ruling will mean that our clients, and many other families too, will finally be able to have peace of mind and be able to move on with their lives, knowing that their future is provided for.” 

JMW act for mesothelioma clients across the globe, with claimants from the Republic of Ireland to New Zealand benefitting from the positive outcome of the Supreme Court battle.

The ruling is predicted to affect thousands of families who have contended with this deadly disease and have lost, or will lose, a relative to it.  It is expected that insurers will have to pay up to £5bn in compensation.
