Successful outcome following road traffic collision in Poland
In July 2019 Mr N was on holiday in Poland. He was stopped at a traffic light when the defendant’s vehicle collided with the back of his vehicle. As a result of the accident he developed a soft tissue injury to his neck, upper back and shoulders. We instructed an Orthopaedic expert who gave a prognosis for his injuries of 6 to 9 months. We pursued the claim in the UK rely on on the Recast Brussels 1 against the defendant’s motor insurers, further to the Fourth Motor Insurance Directive. Polish Law applied to the claim and a Polish lawyer was instructed to advise as to quantum.
The letter of claim was sent on 13th August 2019 to the UK handling agents and liability was admitted on 7th October 2019.
Due to the uncertainties as to whether the UK would leave the EU on 31st October 2019 Court proceedings were issued within the protocol period on 4th October 2019.
The matter settled by way of a Part 36 offer on 4th December 2019 in the sum of £2750.00 which represented a favourable settlement for the client within 6 months of his accident.
