A leap into the unknown?28th January 2019 Personal Injury
I read with interest this week that former Olympic gymnast Beth Tweddle is taking legal action against the makers of TV’s ‘The Jump’ after suffering serious injury on the winter sports show in 2016. It is reported that she hit a barrier on landing a jump which resulted in her needing surgery on her neck and spinal cord. Other celebrities have also suffered various injuries whilst taking part in the Channel 4 programme over the years.
Winter sports are of course hugely popular and at this time of year thousands of us will head for the slopes for some winter fun.
Beth’s injury does highlight the inherent risks when taking part in winter sports and it is sensible to take measures to prevent or prepare for any misfortune you may suffer:
Ensure you have adequate winter sports travel insurance that covers all activities that you intend to take part in this will cover you for medical attention should an accident occur;
Familiarise yourself with the International Ski Federation’s rules of Conduct found here;
Make sure you have all necessary / protective equipment and check it is all in good working order and properly maintained skis, bindings, helmets etc.;
Clearly, even the most experienced and confident skier can still befall an accident whether by the negligence of others, poorly prepared or maintained ski lifts / equipment or insufficient warnings / piste management.
If you are unfortunate enough to be involved in an accident on the slopes it is important to:
Collect the details of all involved including any witnesses / details of insurance;
Obtain a copy of any report made of the incident;
Take photographs of the accident location / faulty equipment;
Contact your travel insurer if warranted;
Request a copy of any medical reports / receipts for your treatment;
Seek legal advice if necessary.
Bringing a successful claim for personal injury is dependent on the incident circumstances, where the incident happened and the details of those responsible. If your winter sports holiday is booked as package holiday and the particular activity was part of that package then you may be able to bring a claim against the tour operator in this country. Even if not a package holiday, in many cases you may still be able to bring a claim against the responsible party or their insurer here in England and Wales. Our experienced team can advise you accordingly.
