Kevin Smith - Cycling Injury

"It was my normal routine commute to work which I had done by bike multiple times. The morning was cold, it had rained the previous night and there was frost on the ground. There is an area where it always flooded when it rained coming from my estate to the main road. I turned left and my bike slipped from under me. I found myself on the road - the area was an ice rink with black ice everywhere, which I had not seen because it wasn’t visible. I realised quite quickly that I was injured and literally a few minutes after my accident a motorcyclist repeated what happened to me. I went to hospital because the pain was severe and was informed that I had a broken elbow and wrist along with extensive bruising. I contacted the council to complain about the ice, and the negligent area as of the flooding every time it rained, they never offered me an apology for the injuries I sustained due to my belief that they were negligent and I felt extremely aggrieved. Having contacted a few injury lawyers who were of the opinion my accident was a low win and not worthy to pursue I thought I would not be able to make a claim. However I checked the internet and found JMW solicitors ‘Twisted Spokes’ team who agreed to pursue my case against Derbyshire County Council. I was introduced to Nadia Kerr. Nadia was great, we worked together to collect evidence of the lack of winter preparation from the council, we agreed to follow social media to ask questions, some of the comments were a little nerve hitting, but Nadia took this in her stride. I had contacted the highways department who agreed there was a flood issue, and they corrected the road drainage, so we had evidence of negligence, and I supplied all of the relevant photos. I can’t thank Nadia enough, as these cases are quite lengthy, and throughout she assured me there was a case, she arranged for me to see a specialist for my injuries and made sure I was kept informed of all developments. It is hard to explain how the other side’s legal team can respond to a case without it feeling personal, but Nadia was again there to assure. When I received the settlement offer I was amazed, and I took Nadia’s advice to accept the offer. The money was great, but the victory against a council for a cyclist was the main thing for me. Please use these guys at JMW even if you think it is an impossible thing to claim against someone like a council, I say go for it give them a call. Kevin"
