JMW successfully obtains remedy for holiday let

JMW acted for a management company client in relation to a property that was being used by a tenant, as an unauthorised holiday let in breach of the lease.

JMW partner Richard Glover and Solicitor Rhiannon Jeal, acted for the management company that was worried that the property was unlawfully being used as a holiday let. There was a long lease in place and therefore swift action was required.

How did JMW help?

Rhiannon wrote to the tenant to set out why the tenant was in breach, requesting the breach to be remedied and to cover our client’s legal costs of enforcing the covenant which were recoverable under the lease.

What was the outcome?

Solicitors for the tenant responded to state that the tenant accepted the breach and would cease letting the property out as a holiday let. Following JMWs advice, when the tenant requested that existing bookings were allowed to continue, our client rejected that request. The tenant accepted this rejection and agreed to pay all of the costs JMW’s client had incurred.
