Successful resolution of proceedings brought against our client for electricity charges over 12 months old

Our experienced team of property litigation solicitors has successfully and swiftly achieved a ‘drop hands’ settlement for a client in response to a claim for the (alleged) payment of electricity charges and interest in the sum of £12,000.

Prior to the claim being issued, our client had disputed the charges directly with the utility provider for a substantial period. The energy provider continued to pursue our client and subsequently commenced court proceedings.

Within a short period of instructing JMW Solicitors, we were able to investigate the matter and write to the utility provider explaining why the electricity charges were not payable by our client. In the particular circumstances of the case, we explicitly informed the utility provider that the charges claimed by it breached the back-billing regulations (since the charges were for electricity from more than 12 months earlier) and it would be barred from recovering the amount claimed by virtue of Condition 21BA of the Standard Conditions of Electricity Supply Licence.

We offered a drop hands settlement which was accepted and the utility provider has since withdrawn its claim and borne the costs associated with the dispute. Our client is no longer liable for such charges and was very pleased with the quick resolution achieved by our property litigation team.
