Successful defence of a challenge to the validity of a will

Ben Wilson was instructed on the defence a challenge to the validity of a will on the grounds of lack of mental capacity and undue influence. Ben was instructed late in the day after taking over conduct of the matter from a different firm. Court proceedings had already been issued against Ben’s client. Ben carried out a detailed analysis of the matter and found a number of deficiencies with the claim, including lack of legal standing, potential abuse of process, and a number of evidential issues. Ben set out these deficiencies in a detail letter to the opponent which led to them discontinuing the claim and agreeing to pay Ben’s client’s costs.
