JMW negotiate amicable settlement and recover financial losses
Background
JMW were instructed by an international producer of high quality and premium wood flooring in relation to the cancellation of a multi-million pound purchase order, by an international architecture company. Over the course of a 2-year period, the client had incurred significant internal costs and expenses in preparation for undertaking the substantial project, turning away other prospective projects to concentrate on this sizeable order. The team were instructed to advise on the recovery of the client’s losses which were in excess of £1million.

The clients instructions were in the first instance to seek an amicable solution with the international architecture company and its main national contractor, as it continued to have other future projects lined up with the said company but did not rule out litigation.
Senior Associate, Kulwant Sokhal and the team reviewed the detailed correspondence passing between the parties which evidenced the agreement and the specific tests and changes that had been requested by the architecture company in preparation for the purchase order. Outcome
The client entered into amicable discussions with the parties and their appointed representatives, which took place over a number of weeks. The client successfully reached an amicable agreement with the architecture company and recovered the majority of its financial losses and preserved its future relationship with the parties, without embarking on expensive litigation.
