JMW’s Commercial Road Transport team successfully prevent operator licence revocation for scaffolding business
Scott Bell (Partner and Head of Commercial Road Transport) has secured yet another great result for a client who faced potential regulatory action against their operator licence.
The client operated commercial vehicles to facilitate its scaffolding business across a large stretch of the North East and North West of England.
Investigations were taken place by the DVSA and the client was subsequently invited to a public inquiry due to evidence of various breaches of its operator licence undertakings. Any significant regulatory action taken against the client’s licence would have had a profound impact on the business’ ongoing commercial operation as well as future work opportunities.
JMW proactively prepared the client’s case and quickly identified solutions for the issues at hand. The client was able to consider the benefit of instructing an independent transport auditor to assist with compliance.
At the inquest, no regulatory action was taken against our client. The client was issued with a warning and an undertaking to perform six-monthly audits with the help of an external independent consultant was able to continue business as usual.
