NCA Most Wanted – Conspiracy to Supply Class A and Class B – Successful Arguments on Full Credit
Hojol Uddin and Elisha Kaur were instructed on the Sentencing for Mr Male following his return to the United Kingdom.
Mr Uddin was initially instructed for successful extradition process in Lisbon’s Supreme Court on Habeous Corpus application with Portuguese and Spanish counterparts.
Upon his return to England, Mr Male pleaded guilty in the first instance, and he was sentenced to 18 years following successful negotiations for withdrawal of firearms offences upon extradition back to England and Wales from Morrocco. The sentence was reduced for time on remand facing extradition in Portugal and Morocco. In addition, the Sentencing Judge tried to prevent Mr. Male from receiving full credit for his guilty plea on return due to a misinterpreted suggestion by the Crown that he had absconded when in fact he was released under investigation. This was successfully argued against the Crown and Judge’s opposition through the reliance of previous case law and public interest arguments. JMW Solicitors also worked alongside Mr Male and his family to compile mitigation for the hearing.
JMW Solicitors are currently instructed on the Proceeds of Crime Act proceedings.
