The client’s problem: Fraud investigation
Our client was at risk of 5 years imprisonment following an investigation for fraud by false representation which was undertaken by the Police. The client found a security flaw in an online investment platform which allowed them to transfer funds from large companies to their own investment portfolio. The client transferred approximately £100,000 and then withdrew approximately £62,000 to a personal bank account. Prior to JMW’s involvement, the client had explained the full details of the alleged offence to the Police who were investigating his claims and had been informed by them the offence would attract a custodial sentence.
How JMW helped
The client instructed JMW and after liaising diligently with the Police, were able to gain a thorough understanding of the investigation and the potential charges our client was facing. Prior to our involvement, a charge was all but inevitable as our client had already admitted to the offence.
Utilising our expertise in representing individuals during the pre-charge stage, alongside our specialism in fraud by false representation matters, we drafted detailed representations to the Police outlining our legal arguments to mitigate any consequences to the client’s admissions. We placed the Police on notice that considering the facts at hand, an out-of-court disposal in the form of a caution was the most appropriate way to conclude this matter.
Outcome: Out of Court settlement
Lauren Bowkett was able to make representations in relation to both the criminal and civil aspects of the investigation which successfully resulted in a conditional caution being agreed against her client.
We were delighted that the Police accepted our submissions and agreed that a caution was the right course of action in the circumstances. In taking this course of action, our client was protected from any further criminal and civil action in relation to the misappropriated funds.
