Speeding – Excessive Fine Reduced for Footballer Client

Hojol Uddin and Jade Halliday-Mitchell successfully advised and represented a footballer (Mr. R) who had been wrongly sentenced to a financial penalty totalling £15,504.00 for one offence of speeding.

Prior to the hearing, Hojol drafted representations in which those instructed applied to re-open Mr. R’s case under S142(1) of the Magistrates’ Court Act 1980. Subsequently, Jade attended the Court hearing and successfully applied for the case to be re-opened, on the basis that the sentence was wrong in law and manifestly excessive. Jade then advocated for a reduced fine in accordance with the guidelines.

The Magistrates’ agreed with Jade’s submissions, and thus reduced the financial penalty to £576.00. The Bench waived the prosecution costs. Mr. R will be recompensed for £14,928.00.
