£5.8 Million Damages for Hospital Error
Lawyers acting for Clair Simpson of Winsford, Cheshire today received the approval of the Court to an award of £5.83 million in compensation for a hospital blunder that left her brain damaged.
Clair, now aged 27 years, will receive the award from the North West Strategic Health Authority. The award follows a mistake made when Clair was aged 11 months, as a result of which she will be entirely dependent upon others for the remainder of her life.
Clair's mother, Veronica Simpson, said:
"No sum of money can ever compensate Clair and ourselves for what we have lost."
Clair was born with a congenital heart defect and underwent open heart surgery at The Royal Liverpool Hospital in December 1981 at the age of 11 months.
The operation was entirely successful but unfortunately during the course of the next few days there was a failure on the part of the hospital to manage her drug therapy. As a result, Clair suffered a cardiac arrest which resulted in extensive brain damage.
Clair is cared for by her parents. It is hoped that in the near future, Clair will be cared for in the family home by specialist carers.
Clair was represented by Sue Taylor from Manchester law firm, JMW, who have a specialist clinical negligence department.
Ms Taylor said:
"I am delighted that Clair's claim has concluded satisfactorily. I can pay tribute to the support and dedication of Clair's parents who for the last 26 years have devoted themselves to the needs of their daughter in extremely difficult circumstances. All those who know Clair and her family will be aware of the difficult challenges that her brain damage presents. It is expected that the award of damages will now at least provide the support that Clair will require for the rest of her life."
