Counterfeit Goods amounting to £4.3 million – Community Order secured.
Background
Jack Murphy and Elisha Kaur were instructed to represent Mr Y in relation to allegations of conspiring to commit offences contravening the Trade Marks Act and acquiring criminal property, the Crown suggested, in excess of £4.3 million.
Investigated by the Northwest Intellectual Property Crime Unit, it was alleged that Mr Y conspired with others in a long running criminal enterprise centred upon the sale of counterfeit luxury goods, associated money laundering, benefit fraud and insurance fraud spanning over 2019 to 2024. The Crown alleged that this was a sophisticated case of concealment with evidence of repeated offending and a significant financial gain for the Defendant’s involved.
How JMW helped
Following lengthy discussions with Crown, Mr Y pleaded guilty to the offences against him however, it was clear from forensic examination of the digital evidence that Mr Y was not a leading role or involved to the same degree as the other Defendants. Alongside careful submissions from Counsel on the evidence, a significant amount of mitigation was advance on behalf of Mr Y and application for full credit to be imposed.
Mr Y was the only Defendant to be sentenced to a community order and no ancillary order was imposed for Confiscation proceedings.
Mr Y provided the following review for JMW Solicitors:
"Excellent legal company to work with, efficient, curteous and excellent results. Highly reccomended.”
