Our client applied for a Prohibited Steps order preventing the Father removing the children from England and Wales together with a Child Arrangements order that the children were to live with her.

The parties had agreed for our client, the Mother, to move to England with the children and that this would be reviewed periodically. The Father remained living in Dubai. A couple of years later the Mother told the Father she would not return to Dubai.

The court found that the Mother had a genuine and deep-rooted fear that the children may be abducted by the Father and taken to Dubai or Jordan where the Father had family and where they had spent time in the past. The court were persuaded by our team that if the children were to stay with the Father outside the jurisdiction, the risk he would retain them was significant and real. In response, the court order a combination of supervised direct and indirect contact within the jurisdiction and our client’s fears were allayed.
