Case Studies
Business Successfully Transferred to Wife
The parties built up a successful business during their marriage which the Husband attributed to his own efforts and the financial assistance the parties had received from his mother. The business was valued at £1.8m and the parties each wanted to retain it and run it themselves.
Acting on behalf of the Wife, our team acted quickly and secured an injunction excluding the Husband from interfering with the business. Our team then went on to secure an order than the business was transferred to the Wife to ensure that she would be provided with an income which would permit her to run her home and maintain and appropriate standard of living for the party’s children.
Summary Return Application Successfully Granted For Father
The family team at JMW acted for a Father in his application for his child to be summarily returned to England and Wales from Dubai. The Mother and Father had agreed to travel to Dubai and the day after arriving there the Mother informed our client that she would be remaining in Dubai with their child. The Mother had made an application for a travel ban in Dubai which had been granted by the courts in UAE.
Notwithstanding the orders already in place, our solicitors successfully argued that the courts of England and Wales had jurisdiction to hear our client’s application and persuaded the court of the advantages of a return order. Our client was over the moon to have his child returned to England and Wales.
JMW Solicitor’s Successfully Retain Entirety of the Family Home For Client
Acting for a Wife, JMW successfully argued that our client should retain the entirety of the equity in the former family home following the party’s separation.
Upon the court considering our clients carefully pleaded case, it found that an investment made by the Husband into a failed business venture, should come from his side of the settlement. The court agreed with our client’s case that the Husband had already had the benefit of his side of the settlement, and he must now bear the consequences of his commercial risk.
Early Resolution of Relocation Application
Our team acted for a Mother who had relocated with her 3 children, from Dubai to the UK. The Father sought the return of the children to Dubai. At the very early stages of litigation our client was delighted when the Father accepted that the children should remain in the UK with her and conceded this part of his case.
The Father continued his litigation in respect of other issues including whether his ability to travel internationally with the children should be limited. Our team’s extensive experience in dealing with these types of cases, meant that we were able to secure an order that our client would retain the children’s passports, and would travel with the children and the Father wherever they went for the foreseeable future. Our team also secured an order that an agreement was to be placed with the Dubai court that the Father would not seek to impose a travel ban on the children if they were ever in Dubai.
