Death by Careless Driving – Custodial Sentence Avoided
Hojol Uddin and Jade Halliday-Mitchell represented Mr. G, who had been charged with causing Death by Careless Driving, avoiding the imposition of a custodial sentence.
Given the sensitive nature of the case for all parties involved, Hojol and Jade approached the case with the utmost care and diligence. A thorough approach was taken, and a Forensic Collision Expert report was obtained. Consequently, Mr. G accepted that his driving had been careless and thus the matter proceeded to sentence.
Jade worked with Mr. G to collate comprehensive mitigation and supporting documents, with the overall aim being to demonstrate that the impact on Mr. G and those around him following the imposition of immediate custody would be catastrophic.
The Sentencing Guidelines for this offence indicate a maximum custodial sentence of 5-years imprisonment. Following expert representation and case preparation, Mr. G was sentenced to community service, rehabilitation days, a driving disqualification of 18-months and costs of £199.00. Custody (suspended or immediate) was avoided.
