Summary Return Opposed on behalf of a Mother
The family team successfully opposed an application for the return of our client’s two children to Dubai from the UK. The children had been brought to the UK by our client on the pretence of a holiday. Whilst the children’s Father agreed to them remaining in the UK our client was concerned that the Father would not return the children to her if they left the jurisdiction for contact with him.
The court was convinced by the evidence put together by the team and held that whilst the risk of the Father retaining the children in Dubai was low, the magnitude of the consequences of that risk, if it were to play out were high. The court ordered that safeguards needed to be put in place and an agreement between the parents setting out the Father’s acceptance that the children were habitually resident in England & Wales and should always be returned there, was to be lodged with the Dubai Courts.
