At JMW Solicitors we offer a range of services to businesses that wish to remain one step ahead with health and safety regulation in their sector. For further information about our services and how they can help you run a workplace which is safe and legal get in touch now on 0800 652 5559.

The Health and Safety Executive and its powers

The HSE has far reaching powers. It can investigate alleged wrongdoing and poor practices in a workplace, and has the right to enforce its powers, carrying out investigations which can result in charges.

Enforcement is designed to ensure that serious risks are dealt with quickly, that businesses comply with the law and that if companies fail to adhere to the law they are held to account.

The HSE can warn duty holders – the person at a company appointed with health and safety responsibilities – that they are failing to uphold standards in writing, as well as face to face. They can also warn that laws are being potentially breached.

The HSE can, in certain cases,:

  • Serve improvement and prohibition notices
  • Withdraw a company’s approvals
  • Make changes to their licences or exemptions
  • Issue formal cautions
  • Prosecute a company
