Compensation for Ureteral Damage

Accidental injury to the urinary tract during a hysterectomy is not uncommon, but it can lead to significant complications and severe abdominal pain if it is not immediately recognised and remedied. The ureters are the tubes that carry urine from the kidneys to the bladder and if they are damaged by the negligence of a medical professional, you may be entitled to claim compensation.

The JMW clinical negligence team has the skills and experience to help you secure the outcome you deserve, and we will be with you every step of the way throughout the process. As well as physical injuries, mistakes in medical treatment or gynaecological surgery can lead to ongoing symptoms, urinary tract infections, psychological distress and financial losses. Our ureteral injury claims solicitors will take all of your losses into account to make a claim for compensation that covers all of your needs.

To speak to a solicitor today in relation to a damaged urinary tract claim, call us on 0345 872 6666, or complete our online enquiry form and we will give you a call back to discuss your situation in more detail. We are able to take on cases on a no win, no fee basis.

Meet Our Team

JMW's experienced medical negligence solicitors have a wealth of experience in securing compensation for ureteral damage and urinary tract injury caused by negligent medical treatment. We have a strong track record of success based on a thorough understanding of the law and the necessary medical standards.

Can I Make a Claim for Ureteral or Urinary Tract Damage?

The bladder or ureters can be damaged during a hysterectomy for a number of reasons. Conditions such as cancer, endometriosis or other pelvic diseases can cause swelling that sometimes makes damage to the urinary tract unavoidable during difficult surgery, because the uterus and bladder are anatomically very close together.

Damage like this should be recognised and, where possible, immediately remedied by the medical professional in charge of your care.
Damage to the urinary tract can also occur while opening the abdomen, particularly if you have undergone previous Caesarean sections, as there may only be a very thin layer of scar tissue separating the two cavities. If the injury is not detected and repaired during the original procedure, you may be entitled to compensation.

What Is the Ureteral Damage Claims Process?

The claims process begins when you get in touch with the team at JMW. We will discuss the circumstances of your ureteral damage and any other related bladder injuries, and your long-term prognosis. These factors will affect whether you can claim and how much compensation you could be owed. If you decide to move forward, we'll arrange for an independent expert to review your medical records and make a judgement on the standards of care you received. Then, we'll contact the doctor, surgeon, hospital, GP surgery or private healthcare facility that was responsible for your care and inform them of your intention to claim.

Most claims are successfully settled at this point through negotiations with the liable party. However, if the other party decides to dispute the claim, or we cannot secure a fair compensation amount through negotiations, we will take the matter to court. JMW will represent you through court proceedings, and continue to negotiate to see if we can settle your case before the court process begins. Find out more in our guide to the medical negligence claims process.

Is There a Time Limit to Claim Compensation?

In most cases, you must claim compensation within three years from the date of your negligent surgery. This three-year time limit is legally binding, although it may begin from the date you realised your injury or its symptoms were connected to your medical treatment.

While certain exceptions apply, it is best to act as quickly as possible to start the legal process. This will also help to make sure you receive compensation that can support your recovery as soon as possible, and will provide for any assistance you need in the aftermath of an injury.

FAQs About Ureteral Injury Medical Negligence Claims

Q
What are the symptoms of damaged ureters?
A

There are several symptoms of a damaged bladder or ureters that could indicate a more serious medical problem, including:

  • Heavy bleeding from the urinary tract
  • Severe and crippling pain in the pelvic region
  • Extreme pain when passing urine
  • A considerable loss of body fluids
  • Problems with the ability to urinate
  • Thick or bloody discharge in the urine

If you experience any of these symptoms following a gynaecological procedure or other surgery, you should consult a doctor at once. If you believe these complications may have been caused by negligent treatment, contact the team at JMW for advice on making a compensation claim.
