No Case to Answer – Successful Acquittal on allegations for Fraud by False Representation and Money Laundering

Hojol Uddin, Jack Murphy, Elisha Kaur and Jack Pittam successfully represented Mr U alleged to have been involved in a conspiracy with others relating to the allegations concerning Fraud by False Representation and Money Laundering.

The case initially began with the Crown bringing allegations relating to the distribution of cocaine by an organised crime group where the Head, although imprisoned, continued to operate his illegal business. In addition, it was alleged that our client’s business was being used as a ‘front’ to launder the criminal proceeds from the operation. Furthermore, the Crown alleged that Mr U has made false statements within the lease application and opened the HSBC business account to allow the Head of the OCG to control and use freely under his name to launder the proceeds from drugs.

Following various applications being made to the Crown at the commencement of the proceedings, the case was amended to remove any allegations of Fraud by False Representation. The case became more streamlined and those instructed were able to prepare for Trial by analysing key financial records and communication between co-conspirators.

During the Trial, instructed Counsel took the decision to make a half-time submission, also known as a Galbraith test, as he strongly believed that there was no case to answer following the presentation of the Crown’s case. The Trial Judge agreed with the Defence submissions and Mr U was acquitted of all counts on the indictment.
