JMW prevent its client from losing a lucrative commercial contract
JMW successfully advised a client in a contractual dispute involving the management of a national hotel chain’s car park. The hotel claimed JMW’s client was in breach of the contract and wanted to remove them from operating the car park. Losing such a lucrative contract would have led to significant financial loss for JMW’s client.
How did JMW help?
JMW Senior Associate Hayley Evans and Solicitor Lucy Ayoubi reviewed the contract and the communications between the parties. They discovered that the hotel was actually in breach of the contract, meaning they owed JMW’s client liquidated damages if they tried to terminate the agreement before the agreed date. JMW were also able to argue why our client was not in breach of the contract (they had rectified the teething issues within the time frame permitted by the contract).

A letter was sent to the hotel setting out our client’s position.
What was the outcome?
The hotel agreed to continue with the contract. The car park is now live and the relationship between the parties has been able to continue.
JMW’s client was very happy, their ideal outcome was for the site to go live. Both our client and the hotel will now make money from this.
