Custodial Sentence Avoided – Serious Injury by Dangerous Driving and Drink Driving
Hojol Uddin and Elisha Kaur successfully represented Mr P alleged to have been involved in a conspiracy with others relating to the allegations concerning the supply of Class A, namely cocaine.
JMW Solicitors were instructed to act on behalf of Mr P based on our vast experience on large scale drug conspiracies and ability to limit one’s role based on the Crown’s evidence presented. Upon instruction, Mr P was adamant that the Crown were “cherry-picking” their evidence and he wanted to place the burden of proof on them. Mr P then instructed JMW to analyse the served cell site data in line with the text messages of others to confirm the correct events on the given date. Once this exercise was completed, Mr P’s role over the 15-month conspiracy was limited to 6 days only. Mr P then entered a guilty plea on basis which was accepted by the Crown.
Mr P was sentenced to 6 years and 7 months following credit and mitigation unlike his co-conspirators who received custodial sentences in the range of 9 to 14 years.
