Making a Claim for Professional Negligence
While it can be common for a professional to provide advice or services that can be considered as ‘bad’, in order to be successful in a claim, there are a number of essential elements that need to be satisfied. These include:
- Being owed a duty of a care by the professional - this will often be established in certain types of professional relationships, such as solicitor/client relationships
- Professionals acting in such a way that breached their duty of care
- Breaches leading to loss or damage
If you wish to make a claim for professional negligence related to commercial or residential property litigation, there are certain time frames that you need to adhere to.
Time Limits for Making a Professional Negligence Claim
For most claims, you will need to bring proceedings within six years of the date of the negligence. This can be a longer period when the negligence did not come to light until a later date. Under these circumstances, you will have three years from the date of knowledge, subject to a long stop date of fifteen years.
If you are considering bringing a claim, it is important to move quickly and act well in advance of the time limits. It can take some time to properly formulate your claim and the Court will expect you to take steps to resolve your dispute before bringing a claim.
Examples of our team’s professional negligence cases include:
Acting for a finance provider in a surveyor negligence claim
We acted for a client against a surveyor who provided negligent advice as to a property value, which resulted in a substantial loss for the finance provider. We recovered a significant percentage of the loss and our client’s legal costs shortly after issuing proceedings.
Acting for an individual in a solicitor negligence claim
We acted for a client against their former solicitors who failed to advise on rights of access to a residential property, which was subsequently found to be landlocked. The resultant claim for diminution in value of the property was successful.
