For an accident at work, this may be your line manager, while a road traffic accident should be reported to the police and an accident in a public place to the local council. This will create a report of the incident that, alongside your medical records, can form a key piece of evidence.

Take photographs of your injuries and the accident scene, if you are able to. Try to collect contact details of anyone who saw the incident take place and can provide a witness statement later.

Is there a time limit for finger amputation claims?

In general, you have a time limit of three years from the date of the incident to issue a claim for a finger injury. Claims are not usually possible outside of this time limit, except in a few specific situations. For amputations that were the result of medical negligence or situations where the cause is not immediately known, the time limit may start from when you first became aware, or should have become aware, that your injury was caused by someone else’s negligence. This is termed the “date of knowledge”.

If you were under 18 at the time of injury, a litigation friend can bring a claim on your behalf at any point before your 18th birthday, with no time limit in place. If no claim is made before then, the three-year limit starts from your 18th birthday, meaning you must begin the claims process before your 21st birthday.

For someone who lacks the mental capacity to make decisions for themselves, the limitation period is suspended for as long as they lack capacity. This means that you can make a claim on their behalf at any time. If the person's capacity returns, you will have three years from the recovery date to begin a claim.
