Injury on a Flight Due to Turbulence - £5,605

The Case
Our client was six hours into a 12-hour flight when she stood up to go to the toilet. The pilot made an announcement warning of possible turbulence, but before she had the chance to react, the plane dropped suddenly. She fell, injuring her foot, and leading to her later experiencing chest pain.
Building the Claim
We sent a Letter of Claim to the airline setting out the circumstances of the incident and the injuries our client had sustained. The airline made an early offer after reviewing her GP and hospital records. However, our client was still experiencing symptoms that were affecting her work, so she agreed to be examined by an independent orthopaedic surgeon instructed by JMW.
We also prepared a schedule of expenses to include any additional financial losses caused by the accident, ensuring every impact was accounted for as part of the compensation claim. Fortunately, our client made a full recovery.
The Final Settlement
Once the medical evidence and schedule of expenses were disclosed, we entered into negotiations with the airline. Using our experience in handling similar cases and knowledge of case law, we achieved an out-of-court settlement of £5,605.
