Fall Caused by Faulty Lighting at Hotel - £15,255

JMW has secured £15,255 in compensation for a client who fractured her ankle after falling on poorly lit hotel steps.

The Case

Miss F was on a package holiday and, one evening, made her way to the hotel restaurant using the steps. While one set of steps was lit, the second set had broken lighting. As a result, she misplaced her foot and fell, fracturing a bone in her foot. This led to ongoing pain and mobility issues.

Building the Claim

JMW Solicitors sent a Letter of Claim to the company through which Miss F had booked her holiday. When the company failed to respond within the six-month protocol period, we made a pre-action disclosure application to the court. This compelled the defendants to provide the required disclosure documents and cover the court application fee.

Miss F was then examined by an orthopaedic expert and a psychologist, who identified that she was experiencing psychological distress following the accident. A course of cognitive behavioural therapy was recommended, which JMW arranged as part of her claim.

The Final Settlement

The defendants did not make a reasonable offer, which meant court proceedings were issued to secure a fair outcome. After negotiation, Miss F accepted a settlement of £15,255.
