Our solicitors secured £50,000 in compensation for our elderly client who needed to undergo a surgical procedure to have steel plates inserted after suffering a fall while on holiday in Lanzarote.

The Case

Mrs B was using the bathroom in her hotel room. She slipped and fell on water on the bathroom floor which she believes was caused by the toilet leaking. The fractures she sustained in the fall caused her pain and swelling, and decreased her mobility and confidence. This then led to her increased need for care for her pre-existing myalgic encephalomyelitis (ME) - also known as chronic fatigue syndrome (CFS).

The Claim

The defendants denied liability, so we called on an expert Spanish lawyer to assist with preparing a report on local standards. We also experienced a number of complications surrounding causation due to Mrs B’s pre-existing ME, so reports from orthopaedic and neurological experts were obtained. 

Final Settlement

Despite the other party denying liability, we were able to negotiate with them, reaching a settlement before court proceedings became necessary. Settlement was reached in the sum of £50,000.
